The type of premises that fall under this regulation include all industrial, commercial or public buildings such as factories, warehouses, offices, shops, hospitals and schools.
The HSE has provided a useful chart detailing the types of premises that fall within this legislation, which can be found on their website.
In many cases, it is clear through tenancy agreements, commercial leases or maintenance contracts who ultimately has the responsibility for the maintenance or repair of the building and is therefore considered the ‘dutyholder’.
It can, however, become blurred if the agreement is not clear, the building is multi-occupied or empty, or there are different areas of responsibility across different parts of the building (common areas, etc.). It is always important therefore that the ‘duty to manage’ is established and that any individuals fulfilling this role undertake the required training to fully understand their obligations.
Regulation 4 requires duty-holders to manage asbestos in non-domestic premises, and:
- Assess whether the premises contain asbestos – its amount, where it is and what condition it is in.
- Assess the risks of anyone being exposed to the asbestos fibres.
- Take action to manage the risk from asbestos by preparing a plan of how the asbestos will be managed and implement the plan.
- Provide information on the location and condition of the materials to anyone who is liable to work on or disturb them.
There is also a requirement on anyone to cooperate as far as is necessary to allow the ‘dutyholder’ to comply with the above requirements.
